Our responsibility
Indochina Travel & Investment Company practices a thorough, realistic Responsible Travel Policy. We believe that travel should entail an exchange of knowledge and perspectives, a sharing of wealth, and a genuine appreciation of Vietnam’s beautiful natural environments. This philosophy underpins the heart and soul of our style of travel. It drives all that we strive to deliver to our travelers, and shapes the contact we have with our supplier colleagues in Indochina. We recognize that poorly planned itineraries or poorly informed tourists contribute less to cross-cultural understanding and less to the livelihoods of local people. We also recognize that we largely work in a developing part of the world. Political and social factors sometimes impede the short term implementation of our responsible travel initiatives, so we do not make blanket, unrealistic statements about the achievability of our goals – doing so would make us ‘irresponsible’. We aspire to short or medium term implementation of our policies where this is realistic and to incremental change where there are constraints of a governmental or cultural nature.
• We accept responsibility if the holiday arrangements we agree to provide are not supplied as described or to a reasonable standard. We further accept responsibility for the acts and omissions of our employees, agents, suppliers and subcontractors (providing they were at the time performing duties authorized by us) except where death or personal injury results (see clause below). The maximum amount of compensation we will consider paying under this paragraph is limited to a refund of the cost of your holiday and the amount of the daily compensation is limited to 25 USD per person. This maximum applies where everything has gone wrong and you have obtained no enjoyment whatsoever from your holiday. In any other situation, we will pay you a proportion of the maximum, at our discretion, taking into account all relevant circumstances.
• We may also accept responsibility should you suffer death or personal injury as a result of any failure to properly perform any part of our contract with you by any of our employees, agents, suppliers and subcontractors (providing they were at the time performing duties authorized by us) except where the cause was due to fault on your part or on the part of third party not connected with the provision of your holiday arrangements and which was unforeseeable or unavoidable even with all due care.
• For all claims, our liabilities in respect of air, sea, road and rail carriers and providers of accommodation are limited as if we were carriers/ providers of accommodation within the relevant International Conventions.
• If in the opinion of ourselves, any airline pilot, accommodation manager, or other person in authority you are behaving in such a way as to cause danger, distress or annoyance to others or damages to property, your holiday arrangements may be terminated by either ourselves or the supplier concerned. In this situation, we will have no liability to you and will not be responsible for making any refunds, paying any compensation, or meeting any costs or expenses you incur as a result of your behavior. Further you must meet any expenses we incur as a result of your behavior.
